Did you know that when a joint tenant dies the survivor inherits the property completely independently of any Will which the deceased person may have made? A joint tenant’s interest in real estate passes immediately to the survivor and does not become part of the deceased person’s estate.

The position with tenants in common is, however, entirely different in that an interest of a tenant in common in equal, or unequal, shares will pass to his or her Estate and will then pass to that person’s beneficiaries pursuant to either the terms of the deceased person’s Will or, alternatively, pursuant to the rules relating to people who die without leaving a Will (“The Intestacy Rules”).
