Our clients generally find this report of interest and assistance and, following receipt and consideration of the report, our clients meet with us to raise any queries not only in relation to the reports but any matters of interest or concerns which they may have.
Buying Property Case Study
A case that we dealt with recently demonstrates why our client was pleased that he engaged an experienced solicitor rather than a Conveyancer. The circumstances were that the townhouse to be purchased had an attractive pergola in the backyard. We advised our client to check with the Council whether there were any orders or requisitions affecting the property. The Council then informed us that it had previously ordered that the pergola is demolished because it stood over a drain and that the vendor had failed to comply with the order. We advised our client that he was entitled to withdraw from the purchase or, alternatively, he could affirm the contract and seek damages.
Ultimately, the matter was resolved by a substantial reduction in the purchase price and an agreement with the Council in relation to the pergola which allowed it to remain in place on the understanding that it would be partially demolished should the Council require access to the drain.
