About Subpoenas
A subpoena is effectively an order of a person to either attend Court or, alternatively, to produce documents to a Court. The most commonly used forms of family law subpoena proceedings are for the production of documents only.
While other types of subpoenas are issued, requiring a subpoenaed party to either give oral evidence or, alternatively, to produce documents and attend court to give evidence, is an important process in a family law matter.
Subpoenas greatly assist parties in obtaining relevant documents for family law matters. They help to establish important facts and information such as monies passing in and out of bank accounts and other important and relevant matters.
There are very limited grounds upon which a person served with a subpoena. They can also object to complying with a subpoena for reasons such as:
- legal professional privilege;
- relevance;
- confidentiality;
- improperly issued subpoenas; and
- an abuse of process.
