A Notary Public (or “Public Notary” or “Notary”) is usually a solicitor appointed by and answerable to their State or Territory Supreme Court and is given statutory powers to witness documents, administer oaths and perform other administrative functions of a national and international nature.

Justices of the Peace (JPs) in Australia are able to provide similar services domestically, but are not permitted to witness documents for use in foreign countries; this right is exclusive to a Notary Public.

Each Notary Public has an official seal which will be stamped onto documents. These seals, along with their signatures, are officially recorded in a database held by the Australian Government’s Department of Foreign Affairs and Trade (DFAT), to ensure that signatures, seals, and stamps of each Notary Public are genuine.

What does a Notary Public do?

A Notary Public is able to:

  • Attest documents and certify their due execution for use in Australia and overseas countries;
  • prepare and certify Powers of Attorneys, Wills, Deeds, Contracts and other legal documents, for use in Australia and foreign jurisdictions;
  • administer oaths for both Australian and international documents;
  • witnesses signatures to Affidavits, Statutory Declarations, Powers of Attorneys, Contracts, and other documents, for use in Australia and foreign jurisdictions;
  • verify documents for use in Australia and foreign jurisdictions;
  • provide certified copies of documents for use in Australia and foreign jurisdictions;
  • prepare official documents for use internationally;
  • note and protest Bills of Exchange; and
  • prepare ships’ protests.

Clive Mills was enrolled as a Notary Public by the Supreme Court of South Wales on 4 April 2013, pursuant to the provisions of the Public Notaries Act 1997.
